Privacy Policy

The data protection and data processing policy of Q Contemporary (company name: Q Contemporary Korlátolt Felelősségű Társaság; registered office: 1062 Budapest, Andrássy út 110.) (hereinafter: QC) is published below in the form of the following privacy policy notice:

Website of QC is accessible to anyone without providing personal data (registration). During your visit of our website, our system records certain data that are used exclusively for statistical purposes and for the optimisation of our website’s appearance, as well as for the enhancement of the system’s security. The data collected contains no personal data. QC uses so-called “cookies” to collect profile and status data (e.g. IP address, browser type, date and time of visit). Cookies are pieces of data temporarily saved from the browser onto your hard drive when visiting the website, in order to allow easier access to the website and faster searches for specific content at later times. You can delete the cookies from your computer any time, and you can also set your browser to block the use of cookies. The website is operated and maintained by AKU Collective OÜ (Pagari 1–4, Tallinn 10133, Estonia).

QC operates a newsletter in order to ensure that those interested stay continuously informed about its latest news. This requires registration on our website providing personal data (full name, email address), which are handled as per the preliminary written consent of the newsletter’s recipient. Any personal data will be processed to the extent necessary for the performance of sending our newsletters based on subscription, and for the time necessary to achieve this purpose.  The newsletters are distributed through the “Mailchimp” international newsletter automation platform, from abroad, therefore in addition to registration, you are required to specifically consent to the forwarding of your personal data to a cross-border third party data processing platform. The Mailchimp platform is operated by The Rocket Science Group, LLC (675 Ponce de Leon Avenue, Suite 5000, Atlanta, GA 30308 USA). Data processing conforming to European Union regulations is ensured by the foreign operator on the basis of the provisions of the “EU-U.S. Privacy Shield Framework” data exchange agreement. You can unsubscribe from the newsletter any time by clicking on the “unsubscribe” link in the newsletter’s footer. This automatically deletes your data stored in the system, but if you write an email to admin@qcontemporary.com with your specific request to have your data deleted, QC deletes your data immediately, but not later than within 15 days.

Beyond data processing based on the subject’s consent, QC processes and forwards personal data only in cases when it is obliged by law to do so. QC only forwards the personal data provided at its disposal to third parties – with the exception of data managers/data processors contractually entitled by QC to do so – with the preliminary and explicit written consent of the subject.

QC ensures the lawful processing of personal data by employing appropriate technical devices, organisational measures and internal regulations. QC exercises special caution in the course of processing and protecting personal data. QC only processes accurate and if necessary, up-to-date data, and only for the duration required to fulfil the purpose of data processing. In case the purpose of data processing has ceased, QC deletes the personal data of the subject immediately, but not later than 15 days.

The rights of the data subjects in connection with the above processing of personal data include the following:

  • Right of access (‘an overview of your personal information’): the right to get an overview of your personal information that we process,
  • Right to rectification (‘correct your personal information’): if your personal information is inaccurate or incomplete, the right to ask us to rectify or complete your personal information,
  • Right to erasure (‘right to be forgotten’): the right to request that we delete your personal information to the extent permitted by the applicable law. In certain circumstances, it may not be possible for us to accept your request; for example, when the processing is necessary to comply with a legal obligation, or if the processing is necessary for the performance of a contract. In some cases, your personal information is necessary in order to provide the Services and if you do not provide such information to us then you may be precluded from accessing and using the Services or using certain Services features,
  • Right to data portability (‘transfer your personal information’): the right to ask us to transfer your personal information directly to you. This applies to certain personal information if processed by automated means and with your consent, or based on a contract you have with us. On your request, and where technically feasible, we will transfer your personal information to another party of your choice,
  • Right to restrict processing: the right to request that we restrict or stop the processing of your personal information held by us for a certain period of time, or for an indefinite period. In certain circumstances, it may not be possible for us to accept your request; for example, when the processing is necessary to comply with a legal obligation, or if we can demonstrate compelling legitimate grounds otherwise,
  • Right to object: the right to object to the processing of your personal information. The reasons for an objection should relate to your particular situation, and be related to processing based on the legitimate interest condition. We will then no longer process the personal information, unless we can demonstrate compelling reasons otherwise. In certain circumstances, you have the unconditional right to object; for instance, in the context of direct marketing activities,
  • Withdrawal of Consent: the right to withdraw your consent to the processing of your personal information at any time; for instance, after you consented to us keeping you informed about our Services, you have the right to withdraw this consent at any time.

QC immediately, but not later than within 15 days of receipt of the data subject’s request, takes the necessary steps to comply with such request and process the personal data accordingly.

If the subject believes that the processing of their data is exercised by the QC in an unauthorised manner, they can object to the processing of their data. This objection is immediately, but not later than within 15 days of receipt of the request, inspected by QC, and the objecting subject is informed of the inspection’s result in writing – meanwhile the procession of the subject’s data is suspended. If QC fails to meet the deadline, or fails to comply with the request, the subject is entitled to turn to the Budapest Capital Regional Court or to the competent Regional Court of their permanent or temporary place of residence for legal remedy.

In case of personal data breach, or in case of immediate danger of breach, the subject or any third party may request investigation by submitting a report to the Hungarian National Authority for Data Protection and Freedom of Information (NAIH).

This notice is based on the following regulations:

  • Act CXII of 2011 on the Right of Informational Self-Determination and on Freedom of Information;
  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation);
  • Act XLVIII of 2008 on Essential Conditions of and Certain Limitations to Business Advertising;
  • Act CVIII of 2001 on certain issues of electronic commerce services and information society services.
